MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 91-83 <br />i. <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION RECOMMENDING A REZONING AND GRANTING <br />VARIANCES FOR PLANNING CASE 131-83 <br />WHEREAS, the City has received an application from Mr. <br />Gordon Bayerkohler, owner of property located at 7801 Sunnyside <br />Road, to convert the existing four unit residential building <br />located on this property to an office building; and <br />WHEREAS, this proposal requires a rezoning of the property. <br />from R-3, Medium Density Residential to B-2, Limited Business <br />District; and <br />WHEREAS, the proposed conversion to an office building <br />also requires a building side yard setback variance and reduced <br />number of parking spaces variance; and <br />WHEREAS, notices of the Planning Commission informational <br />meeting were sent to all property owners who reside on Sunnyside <br />Road between Highway 10 and Hillview Road in addition to being <br />posted in the two apartment buildings immediately east of this <br />existing fourplex; and <br />WHEREAS, no response was received from any of these <br />residents concerning this proposal; and <br />WHEREAS, the Planning Commission identifies no negative <br />impacts on the surrounding property as a result of the proposed <br />rezoning to B-2; and <br />WHEREAS, the Planning Commission has reviewed the request <br />for a building side yard setback variance on the east side of the <br />property; and <br />WHEREAS, this side yard setback variance is justified <br />since the proposed use of the building is not creating the need <br />for this variance; a continuation of the non -conforming setback <br />is being requested since the setback for both the existing use <br />and proposed use do not meet minimum Zoning Code requirements; <br />and <br />WHEREAS, the Planning Commission has also reviewed the <br />request for a variance of two parking spaces; and <br />WHEREAS, in order to preserve the natural tree/shrub <br />buffer, green space, and the drainage of the site, a two <br />VOR.'. 9 P g - parking <br />.'. space variance is needed; and <br />
