MOUNDS VIEW PLANNING COMMISSION <br />• RESOLUTION NO. 93-83 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION APPROVING VARIANCES FOR THE DYNAMIC DESIGNERS PROPOSAL <br />WHEREAS, Mr. Jim Cepress and Mr. Art Fretag of Dynamic <br />Designers have requested approval to construct an 8 -unit <br />condominium at 7656 Woodlawn Drive; and <br />WHEREAS, the location of this property and proposed <br />building lie within a designated wetland zoning district; <br />WHEREAS, Section 48.06 Subdivision 4 A (1) of the Mounds <br />View Municipal Code allows for dimensional requirement <br />modification to further the purposes of the wetland ordinance; <br />and <br />WHEREAS, the location of the building as proposed to <br />remain out of the wetland proper would require approval of the <br />following variances: <br />a) Building side yard setback of 6 feet. <br />b) Building front yard setback of 7 feet. <br />c) Parking area curbing setback of 4 feet. <br />d) Variance to the requirement that all structures <br />be setback at least 100 feet from the wetland. <br />WHEREAS, the Planning Commission identifies the following <br />as hardships by which a variance is needed: <br />a) The property was acquired by Dynamic Designers <br />prior to the adoption of the Wetland Ordinance. <br />b) The present condition was not developer created. <br />c) Without a variance to the requirement that all <br />structures be setback at least 100 feet from the <br />wetland, the property would be rendered undevelop- <br />able. <br />NOW, THEREFORE, BE IT RESOLVED that contingent upon <br />approval being given by the Mounds View City Council to combine <br />the two lots under consideration into one and evidence of the <br />recording of deeds being submitted to the City, the Mounds View <br />Planning Commission hereby approves the following: <br />1) A 6 foot variance to the building side yard setback <br />requirement. <br />2) A 7 foot variance to the building front yard <br />setback requirement. <br />
