MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 99-83 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RECOMMENDATION TO THE CITY COUNCIL REGARDING PLANNING CASE 144-8 <br />WHEREAS, JoAnn Chaika, owner of property located at 5084 <br />Long Lake Road, has submitted an application to rezone this <br />property from R-l, Single Family Residential to R-2, Single and <br />Two Family Residential; and <br />WHEREAS, the rezoning is necessary due to the applicant's <br />desire to construct a second kitchen facility in her existing <br />single family home which constitutes, by definition, another <br />dwelling unit, thus requiring an R-2 zoning; and <br />WHEREAS, the Mounds View Planning Commission has received <br />and reviewed the staff planning report and other relevant <br />material regarding this application; and <br />WHEREAS, the entire area surrounding this property is <br />zoned R-l, Single Family Residential; and <br />WHEREAS, a rezoning of this parcel of land to R-2 would be <br />considered spot zoning which, according to the publication <br />entitled, "Local and Regional Planning in Minnesota" by Gunnar <br />Isberg, is defined as the rezoning of a single parcel of land or <br />a relatively small area for higher intensity use than land <br />surrounding the particular parcel of land; and <br />WHEREAS, the City has consistantly denied any rezonings <br />which constitute spot zoning; and <br />WHEREAS, a rezoning of this property from R-l to R-2 would <br />set a precedent whereby other property presently zoned R-l, <br />Single Family may request rezoning to R-2, which may seriously <br />weaken the integrity of the R-l zoning; <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View <br />Planning Commission recommends to the City Council that the <br />request to rezone the property at 5084 Long Lake Road from the <br />exising R-l, Single Family zone to R-2, Single and Two Family <br />Residential zone be denied;
