ITEM #6 <br /> REQUEST FOR PLANNING COMMISSION ACTION • <br /> Meeting Date: May 21, 1997 <br /> Staff Report by: James Ericson, Planning Associate <br /> Planning Case No.: 483-97 <br /> Request: The applicant is requesting a Conditional Use Permit to <br /> operate outdoor sales of produce at Moundsview Square. <br /> Applicant: Kirk Olson, representing Merryville Farm Market <br /> Location: Moundsview Square Shopping Center parking lot <br /> PIN No. 07-30-23-11- 0079 <br /> Zoning/Land Use: R-4, Regional Business District; Moundsview Square Shopping Center <br /> Applicable Regulations: <br /> Section 1125.01, Subd. le, states that the Planning Commission shall consider possible adverse <br /> effects of the proposed conditional use, based upon the following factors: <br /> 1. Relationship to the Municipal Comprehensive Plan. • <br /> 2. The geographical area involved. <br /> 3. Whether such use will tend to or actually depreciate the area in which it is proposed. <br /> 4. The character of the surrounding area. <br /> 5. The demonstrated need for such a use. <br /> Section 1125.01, Subd. lg, states that the Planning Commission shall make findings of fact and <br /> recommend such actions or conditions relating to the request as it deems necessary to carry out <br /> the intent and purpose of the Zoning Code and forward such findings to the City Council. <br /> Chapter 1115.04, Subd. 2, provides for open or outdoor service, sales and rental as an accessory <br /> use including sales in or from motorized vehicles, trailers or wagons; provided that: <br /> a. Outside service, sales and equipment rental connected with the principal use is limited to <br /> 30 percent of the gross floor area of the principal use. <br /> b. Outside sales area is fenced or screened from view of neighboring residential uses or an <br /> abutting residential district in compliance with 1103.08 (1)through(5) of the Zoning <br /> Code. <br /> c. All lighting shall be hooded and so directed that the light source shall not be visible from <br /> the public right of way or from neighboring residences and shall be in compliance with <br /> Section 1103.09 of the Code. • <br /> • d. Sales area is grassed or surfaced to control dust. <br />
