The Board of Adjustment and Appeals may impose such <br /> restrictions and conditions upon the premises benefited by a variance as may be necessary to <br /> comply with the standards established by this Title or to reduce or minimize the effect of . <br /> such variance upon other properties in the neighborhood and to better carry out the intent of <br /> the variance. <br /> Attachments: Planning Application <br /> Zoning Map <br /> Building Plan <br /> Hardship Statement <br /> Encroachment Map <br /> Background: <br /> The applicant is requesting a 4 foot variance to the front yard setback to build a covered entryway <br /> on the house currently under construction at 5377 Quincy Street. The property is located in an • <br /> established neighborhood consisting of older, single family homes. This lot was created in 1989 <br /> as a result of a minor subdivision of 2186 Bronson Street. The property, though conforming to <br /> the dimensional requirements for buildable lots, is irregularly shaped in that the parcel is wider <br /> than it is deep. With the 30-foot front and rear setbacks, the maximum depth for a home on this <br /> lot could be 24 feet. The applicant is utilizing all of this 24 feet and requests an additional 4 feet <br /> for the covered entryway. <br /> John Hall, the applicant's Associate Construction Manager, has submitted a hardship statement <br /> regarding its request. Mr. Hall has stated that the hardship in this caseis that the front and rear <br /> setbacks do not allow for any latitude with regards to building location. The types of homes built <br /> by the applicant all include covered entryways to provide protection to the residents and guests <br /> from the weather. <br /> Analysis: <br /> The lot in question is irregularly shaped because of the 1989 minor subdivision and does present <br /> practical difficulties in locating a house on the lot. The applicant has already begun construction <br /> of the home which eliminates the possibility of shifting its location. The covered entryway, if <br /> approved, would encroach four feet into the setback. Staff has examined front setbacks on <br /> Quincy Street from Bronson Drive south to County Road 1-12 and found that four out of the six <br /> homes on the west side of Quincy within this two block range encroach into the 30 foot front • <br /> setback. A map has been attached that illustrates this situation. <br />
