G. Engen is requesting a variance to allow for a permanent driveway surface within the five- <br /> .. - <br /> :. - - - - . .� .... •r. _en s exis ing <br /> asphalt driveway needs to be replaced and it is his desire to replace the asphalt drive with a cement <br /> driveway surface. The existing driveway is within a foot of the side yard property line. In his letter <br /> requesting the variance, Mr. Engen desires to retain the driveway at its current width to allow him <br /> access into the garage while parking vehicles on the side of the drive. If the new driveway were to <br /> be located so that it would not encroach into the five-foot side yard setback, a fence and 40 year <br /> old trees would need to be removed. The next-door neighbor impacted by this request has <br /> submitted a letter indicating their approval of a cement driveway closer than 5 feet to their property <br /> line. <br /> • Analysis: <br /> Section 1104.01, Subd. 4 of the Mounds View Municipal Code requires that driveways be set back <br /> five feet from side yard property lines. This dimension may be reduced to'one foot for temporary <br /> surfaces with permission from the abutting property owner. Temporary surfaces, according to the <br />
