Planning Commission Report <br /> Silver Lake Commons Amended Development Review <br /> Planning Case No. 487-97 and 504-97 <br /> 4) September 3, 1997 <br /> Page 5 <br /> Park Dedication Requirements: <br /> Section 1204.02 of the Mounds View Municipal Code requires that any subdivider of land shall <br /> make a payment to the City for park dedication purposes in an amount set forth by the Code. For <br /> residential developments, the fee is based on gross density, or in other words, dwelling units per <br /> acre. For developments having gross densities in excess of 5 dwelling units per acre, the fee is <br /> and amount equal to ten percent of the fair market value of the land being subdivided. Staff <br /> presumes that an appraisal of the vacant lots was performed for this development and will seek to <br /> gain a copy of this appraisal before your meeting. Staff will require that the appropriate payment <br /> be made prior to action of this request by the City Council. <br /> Easements: <br /> Staff has requested that easements be dedicated for drainage and utility purposes on the combined <br /> lot along the property lines and over any area set aside for ponding or water retention. Ten feet <br /> will be required along the front and rear property lines and five feet for the side property lines. <br /> These easement areas are shown on the Certificate of Survey, with the exception of the ponding <br /> • or retention area, pending the City Engineer's review. These easements shall be executed by <br /> means of a document to be recorded with Ramsey County prior to the Mayor's and the City <br /> Administrator's signatures appearance on the Certificate of Survey. <br /> Changes to Survey: <br /> Staff has requested that the Certificate of Survey be amended prior to City Council action on this <br /> request to reflect the addition of three things. First, the title "Certificate of Survey" shall be <br /> added to the survey. Second, a signature block bearing the names of the Mayor, Duane McCarty, <br /> and City Administrator, Charles Whiting; in addition to the name(s) of the pi operty owners of the <br /> development shall be added to the survey. Last, a block of text shall be added to the survey <br /> which states: <br /> "A separate easement document, Document No. , has been recorded with <br /> Ramsey County on this day of , 1997 which perpetually dedicates those <br /> areas so designated on this certificate for drainage and utility purposes to the City'f <br /> Mounds View. " <br /> Other Issues: <br /> • There are two problems as a result of this minor subdivision that staff recently uncovered. The <br /> 26-unit parking garage and attached office and recreation area cross the lot line between the <br />
