Upon receipt of your September 3 letter, I called you <br /> and informed you of our disagreement. You referred me to City Attorney Bob Long, <br /> with whom I had a lengthy telephone conversation. In that conversation, I detailed <br /> how your proposed application of the park dedication requirement to this project is <br /> contrary to the language and intent of the Mounds View subdivision ordinance and <br /> represents a radical departure from how the City has applied the same ordinance to <br /> similar re-subdivision applications in the past. Several different City administrations <br /> over an extended period of time have consistently applied the ordinance so as not to <br /> require additional park dedication fees on the re-subdivision of commercial land for <br /> which park dedication fees have previously been paid on a prior subdivision. <br /> Mr. Long acknowledged that he anticipated our disagreement with your proposed <br /> application of the park dedication requirement, and that the language of the current <br /> ordinance does not clearly support your interpretation. On September 8, 1997, we <br /> submitted a Planning Application for the Building N replat (Mounds View Business Park <br /> East 2nd Addition). The identical replat of the Building N site was originally approved <br /> by the City in 1994 under the current subdivision/park dedication ordinance. We <br /> request that the Building N plat application be scheduled for review and consideration <br /> at the first available City Council meeting. Since the application involves reapproval <br /> of the same plat previously approved, we do not believe Planning Commission review • <br /> is necessary.
