• PLANNING COMMISSION <br /> MEMO <br /> To: Mounds View Planning Commission <br /> From: James Ericson, Planning Associate <br /> Subject: Code Interpretation: Section 1121.10, Subd 6. <br /> Date: Meeting of October 1, 1997 <br /> Background: <br /> The property owner of 2109 Hillview Road, Don Leshovsky, has approached the City with a <br /> desire to install temporary parking spaces adjacent to the existing improved parking area. This <br /> has come about as a result of vehicles being parked on the grass at this four-plex. Installation of <br /> temporary spaces consisting of class 5 gravel would alleviate the parking problems being <br /> experienced. <br /> Analysis: <br /> 4111 On the surface, this request seems simple enough. However, it was pointed out by the Rick <br /> "arson, the City's building inspector, that gravel parking surfaces are not allowed in this particular <br /> zoning district. (The four-plex is located in an R-3 District.) I could not find reference to this <br /> disallowance in the Code until I found Section 1121.09, Subd. 6, which pertains to "Grade <br /> Elevations." I have included a copy of this for your reference. The Code does state that except <br /> for R-1 and R-2 districts, all driveways and parking areas shall be bituminous. (Concrete is not <br /> even listed as an option.) However, further down in the same paragraph, temporary surfaces are <br /> addressed, whereby gravel surfaces are allowed. I think the two references conflict with each <br /> other making the intent of the subdivision unclear. In its travels through the City, Staff has <br /> observed a number of temporary and unimproved parking areas/driveways in the R-3 District. <br /> Recommendation: <br /> The Planning Commission, acting as the Board of Adjustments and Appeals, needs to interpret the <br /> Code with regard to gravel parking surfaces in districts other that R-1 and R-2 to determine <br /> whether a temporary surfaces would be allowed at 2109 Hillview Road, until such time that the <br /> Code can be rewritten to clarify this reference. <br /> S <br />
