• PLANNING COMMISSION
MEMO
To: Mounds View Planning Commission
From: James Ericson, Planning Associate
Subject: Planning Case No. 509-97
Date: Meeting of December 17, 1997
Background:
Staff has received a request from Mahmoud M. Abughweili to open a tobacco shop in Silver
View Plaza, which is zoned B-2, Limited Business District. Since"tobacco shop" is not listed as
one of the permitted uses in this district, staff is seeking guidance from the Planning Commission
on a code interpretation whether or not such a use should be allowed.
• Discussion:
Low intensity, retail or service outlets which deal directly with the customer for whom the goods
or services are furnished are typical of this district. Examples of such uses are finance agencies,
health and beauty salons, antique shops, delis, drugstores, etc. While a tobacco business is not
specifically listed as a permitted use, staff would contend that it is the type of use that would be
appropriate for this zoning district. In fact, some of the listed uses (drugstore, liquor store and
convenience grocery) are ones where a person would likely find tobacco products. If the Planning
Commission feels the same way, staff would recommend that a tobacco shop be interpreted as a
drug store and as such, be allowed in Silver View Plaza, property zoned B-2, Limted Business
District.
Recommendation:
The Planning Commission, acting as the Board of Adjustments and Appeals, finds that a limited
retail use offering to the public tobacco products shall be considered a drug store for the purpose
of interpreting the Zoning Code, until such time that the Zoning Code is updated and a specific
reference to tobacco shops is added.
N:\data\groups\comdev\devcases\509-97\tobacco.pc
