Planning Commission Resolution No. 513-98 <br /> • February 18, 1998 <br /> Page 2 <br /> WHEREAS, the literal interpretation of the provisions of the City Code does not deprive <br /> the applicants of rights commonly enjoyed by other properties in the same district; and <br /> WHEREAS, the conditions which necessitate the variance request were known by the <br /> applicant prior to purchasing the property in that the applicant is not required to build a home at <br /> the proposed size; and <br /> WHEREAS, granting this variance requested will confer on the applicants a special <br /> privilege that is denied by this Title to owners of other lands, structures or buildings in the same <br /> district in that building setbacks from a public street require a 30 foot setback in the R-1 zoning <br /> district; and, <br /> WHEREAS, the variance would be materially detrimental to the purpose of this Title and <br /> to other properties in the same zone in that the building setback would be 7 feet less than what is <br /> allowed by Code. <br /> NOW, THEREFORE, BE IT RESOLVED, that the Mounds View Planning Commission <br /> acting as the Board of Adjustment and Appeals denies the variance request of Preferred Builders, <br /> Inc. for a reduction in the building setback requirement to a public right-of-way from 30 feet to <br /> 23 feet for the construction of a single-family home at 8265 Spring Lake Road. <br /> Adopted this 18th day of February, 1998 <br /> ATTEST <br /> Rick Jopke, <br /> Community Development Director <br /> SEAL <br /> • N:\DATA\GROUPS\COMDEV\DEVCASES\513-981532-2-98.RES <br />
