4110 Staff Memo To: Economic Development Commission Members From: Cathy Bennett, Economic Development Coordinator Date: August 17, 1994 Agenda Item: Other Business The following items under Other Business are primarily for commission member's review. These items are for discussion and no action is needed. Open Meeting Law: 0 Since this is a new commission and not all parties are familiar with the required procedures of public meetings, I thought it may be beneficial to have you review the Open Meeting Law. The State statute notes the requirements for making all the materials available to the public and procedures for calling special and emergency meetings. An interpretation of the law notes that a quorum of commission members (4 members) are allowed to conduct commission businesses. Therefore, any time when there are four or more members together the "meeting" must be posted and made public. Economic Development Authority Powers: At the last meeting there was an inquiry regarding acquisition procedures and how long the City, or in this case EDA, could own property without making any improvements to the vacant land and/or building. The attachment outlines the powers of an EDA which allows a broad scope of possibilities, including acquisition. This does not specifically address the above question but prior to the meeting I will consult the City's attorney and bring the information to the meeting. In addition, I have been trading phone calls with the broker for the vacant gas station • site on Highway 10. Hopefully I will have more information regarding the property prior to the meeting.
