MOUNDS VIEW PLANNING COMMISSION <br /> RESOLUTION NO. 547-98 <br /> 1110 <br /> CITY OF MOUNDS VIEW <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION APPROVING A REDUCTION IN THE FRONT SETBACK <br /> REQUIREMENT FROM 54 FEET TO 37.4 FEET FOR CONSTRUCTION <br /> OF A FOYER/ENTRYWAY AT 2824 WOODALE DRIVE; <br /> PLANNING CASE NO. 524-98 <br /> WHEREAS, the Mounds View Planning Commission has reviewed the request of Ron <br /> and Jan Overton to allow a 37.4-foot front setback where 54 feet is required, for the construction <br /> of a finished entryway/foyer at 2824 Woodale Drive; and, <br /> WHEREAS, this property is zoned R-1, Single Family Residential District and is legally <br /> described as: <br /> Lot 93, Knollwood Park, Ramsey County, Minnesota <br /> WHEREAS, the Planning Commission has reviewed the following documents associated <br /> with this request: <br /> • 1. Planning Application <br /> 2. Zoning Map <br /> 3. Site Plan <br /> 4. Letter from the Applicant <br /> 5. Letter from JoAnn Valley <br /> 6. Letter from David Rudnik <br /> 7. Encroachment Map <br /> WHEREAS, the applicable front setback for this property is 54 feet, which is based upon <br /> the house that is closest to the street on this particular block of four homes; and, <br /> WHEREAS, Section 1104.01, Subdivision 3 of the City Code was amended in 1996 by <br /> Ordinance 590 to protect the uniformity and continuity of homes set back further than the <br /> required minimum 30-foot front yard setback; and, <br /> WHEREAS, prior to the adoption of Ordinance 590, the minimum setback for this <br /> property would have been 30 feet; and, <br /> WHEREAS, the literal interpretation of the provisions of this Title would deprive the <br /> applicant of rights enjoyed by other owners of homes in the same district that are set back further <br /> than the required 30 feet, so long as there is a property within that same block that sits closer to <br /> the street; and, <br /> • <br /> WHEREAS, special conditions or circumstances do not result from the actions of the <br />
