• REQUEST FOR PLANNING COMMISSION ACTION <br /> Meeting Date: May 20, 1998 <br /> Staff Report by: James Ericson, Planning Associate <br /> Planning Case No.: 528-98 <br /> Request: Conditional Use Permit for a Residential Dog Kennel <br /> Petitioner: Scott& Marcia Dumonceaux <br /> Location: 2359 Pinewood Circle <br /> PIN Nos. 05-23-30-34-0073 <br /> Zoning/Land Use: R-1, Single-Family Residential/ Single Family Home <br /> Applicable Regulations: <br /> • Municipal Code Section 701.03, Subdivisions 1, 3, and 15, regarding the licensing of dogs <br /> and operation of kennels. <br /> • • Municipal Code Section 1106.04, Subdivision 3, which requires a conditional use permit <br /> for residential dog kennels in an R-1, Single Family Residential district. <br /> • Municipal Code Section 1125.01, Subdivision 3b, which identifies the criteria to be used <br /> for granting a conditional use permit. <br /> Attachments: 1. Planning Application <br /> 2. Zoning Map <br /> 3. 500 Foot Map <br /> 4. Petition <br /> 5. Resolution No. 550-98 <br /> Background: <br /> The applicants, Scott and Marcia Dumonceaux of 2359 Pinewood Circle, are applying for a <br /> conditional use permit for a residential dog kennel, a Code requirement for property owners with <br /> three or four dogs. One of the licensing requirements is that the property owner shall obtain <br /> signatures of approval from more than 50 percent of the residents within 500 feet of the property <br /> proposing the kennel. The applicants were sent a map showing those properties within 500 feet <br /> along with a corresponding list of property owners/taxpayers. <br /> Analysis: <br /> • On the map the staff sent to the applicants, 56 properties were highlighted, which means that 29 of <br /> the property owners would need to sign the petition, which was also provided by staff. The <br /> applicants collected 30 signatures approving of the kennel request. All of the properties adjacent to <br /> 2359 Pinewood Circle, of which there are five, have indicated their approval of the application. <br />
