PLANNING COMMISSION
MEMO
To: Mounds View Planning Commission
From: James Ericson, Planning Associate
Subject: Discussion of Proposed Ordinance 628
Meeting Date: February 3, 1999
Background:
At previous meetings of both the Planning Commission and City Council, the issue of requiring
Conditional Use Permits for temporary outdoor sales operations such as Merriville Farm Market
and Linder's Greenhouses has been called into question. With that in mind, staff has asked the
City Attorney to draft an ordinance to allow such businesses as permitted uses within a B-3,
Highway Business; B-4, Regional Business; or I-1, Industrial District.
• Discussion:
The draft ordinance attached to this report addresses only sales of produce but not lawn and
garden sales. These additions will be made as appropriate in the second draft of the ordinance.
The adoption of this ordinance would not, however, change the requirements for other types of
outdoor sales operations, such as Vikings Super Bowl t-shirt sales or black-velvet Elvis painting
sales, which would still require a CUP. Due to issues of fairness, staff asks the Commission to
discuss whether or not all outdoor sales should be included in this ordinance.
Recommendation:
Discuss the proposed ordinance regarding outdoor sales and direct staff to make changes as
appropriate, forwarding the ordinance onto the City Council for first and second reading.
James Ericson, Planning Associate
N:\DATA\GROUPS\COMDEV\PLANCOMM\BYLAW S\PCREPORT.99
•
