Planning Commission Resolution 576-99 <br /> Dietrich Variance <br /> April 7, 1999 <br /> II/ Page2 <br /> WHEREAS, the variance requested is the minimum variance which would alleviate the <br /> hardship, in that the variance requested is not based upon a specific distance but rather the <br /> physical location of the accessory structure between the house and street which is the minimum <br /> variance required to alleviate the hardship; and, <br /> WHEREAS, the variance would not be materially detrimental to the purpose of this Title <br /> or to other properties in the same zone in that no surrounding properties will be impacted by this <br /> allowance as the homes are oriented to take full advantage of the lake; and, <br /> WHEREAS, the variance would not impair an adequate supply of light and air to adjacent <br /> property or substantially increase the congestion of the public streets or increase the danger of fire <br /> or endanger the public safety or substantially diminish or impair property values within the <br /> neighborhood in that the construction of a garage would not impair the supply of light and air to <br /> adjacent properties or possibly increase the congestion of the public streets or increase the danger <br /> of fire or endanger the public safety or substantially diminish or impair property values within the <br /> neighborhood. <br /> NOW, THEREFORE, BE IT RESOLVED, that the Mounds View Planning Commission, <br /> acting as the Board of Adjustment and Appeals, approves the variance requested by Ms. Dietrich <br /> • to allow for a garage to be located between the principal structure and street at 7805 Gloria <br /> Circle. <br /> NOW, THEREFORE, BE IT FURTHER RESOLVED, that the proposed garage shall <br /> conform to all setback requirements as would be applied to a principal structure and conform to <br /> the dimensional requirements for accessory structures in a single-family residential district. <br /> Adopted this 7th day of April, 1999. <br /> Jerry Peterson, Planning Commission Chairman <br /> ATTEST <br /> Rick Jopke, Community Development Director <br /> • SEAL <br /> N:\DATA\GROUPS\COMDE V\DEVCASES\5 51-991576-9 8 A RES <br />
