• <br />• <br />• <br />REQUEST FOR PLANNING COMMISSION ACTION <br />Meeting Date: July 21, 1999 <br />Staff Report by: James Ericson, Planning Associate <br />Planning Case No.: 564-99 <br />Request: The applicant is requesting a Conditional Use Permit to <br />operate an outdoor sales produce stand at the Holiday Stationstore <br />Applicant: Holiday Stationstore <br />Location: 2744 Highway 10 <br />PIN No. 06-3 -23 -43 -003 8 <br />Zoning/Land Use: PUD Planned Unit Development / Convenience and Gas Station <br />Applicable Regulations: <br />• Section 1114.04, Subd. 5, which allows for open or outdoor service, sales and rental as an <br />accessory use with a conditional use permit. <br />• Section 1125.01, Subd. le, which states that the Planning Commission shall consider <br />possible adverse effects of proposed conditional uses. <br />• Section 1125.01, Subd. lg, which states that the Planning Commission shall make findings <br />of fact and recommend such actions or conditions relating to the request as it deems <br />necessary to carry out the intent and purpose of the Zoning Code and forward such <br />findings to the City Council. <br />Attachments: Planning Application <br />Zoning Map <br />Site Plan <br />Letter from Chuck Durand, 5/26/99 <br />Resolution 589-99 <br />Background: <br />Chuck Durand, representing the Holiday Stationstore, is requesting a conditional use permit to <br />operate an outdoor produce stand in the parking lot of the Holiday Stationstore, located at the <br />southeast corner of Highway 10 and Silver Lake Road from July through October of this year and <br />years thereafter. The produce is planned to be open from dusk to dawn seven days a week. The <br />stand would be operated by Darcy Ewing of Big Lake, Minnesota. The stand or sales tent is <br />proposed to be 12 feet square and would be located in the grassy area immediately adjacent to the <br />bank of parking stalls at the north corner of the lot. If there are no problems with the operation, <br />the applicant would like the opportunity to operate in subsequent years as was done with Linder's <br />and Merryville farm market. <br />
