Thrifty Car Rental <br />2975 Highway 10 <br />July 21, 1999 <br />Page 2 <br />Analysis: <br />Section 1114.04, Subd. 5 of the City Code requires that a conditional use permit be issued for uses <br />such as that proposed by the applicant . Specifically, it states that "Open or outdoor service, sale <br />and rental as a principal or accessory use and including sales in or from motorized vehicles, trailers <br />or wagons requires a Conditional Use Permit." The primary function of the proposed business is <br />the renting of automobiles, with an accessory use of sale of said rental vehicles. Because of the <br />restrictions placed upon auto sales operations, the extent of Thrifty's auto sales may not exceed 30 <br />percent of its gross floor area which translates into no more than three vehicles. This location has a <br />long history of automotive uses, and the proposed use would not be inconsistent with the previous <br />uses. The zoning of the property is commercial although the comprehensive plan indicates a low <br />density residential designation. Because of the long-standing commercial history at this location <br />and the impending revision to the comprehensive plan which could redesignate this parcel to a <br />commercial use, staff feels that the inconsistency with the comprehensive plan could be temporary. <br />Criteria: <br />The conditions placed upon rental businesses, as stated in Section 1114.04, Subd. 5 of the City <br />Code, were listed in the previous staff report and are now present in the proposed resolution of <br />approval. In addition to the addressed CUP conditions and the adverse affects requirements, the <br />Code also requires that certain findings of fact be addressed in the grantingof any conditional use <br />permit. These criteria appeared in the previous staff report as well and are now listed in the <br />resolution of approval. <br />Recommendation: <br />Staff is recommending that the Planning Commission discuss this proposal and take action on <br />Resolution 586-99, a resolution recommending approval of an auto rental operation at 2975 <br />Highway 10 for Thrifty Car Rental, with stipulations and any amendments the Commission feels <br />• <br />• <br />necessary. <br />Nia- A.24 � e� <br />James Ericson, Planning Associate <br />N:\DATA\GROUPS\COMDEV\DEVCASES\562-99\THRIFTY.PC2 <br />
