REQUEST FOR PLANNING COMMISSION ACTION <br /> Meeting Date: October 6, 1999 <br /> Staff Report by: James Ericson, Planning Associate <br /> Planning Case No.: 570-99 <br /> Applicant: Jeff Johnson <br /> Request: The applicant is seeking a variance for a one-foot sideyard setback <br /> to construct two three-stall garage structures <br /> Location: 2075 & 2081 Hillview Road <br /> PIN Nos. 05-30-23-41-0011 & 005-30-23-41-0005 <br /> Zoning/Land Use: R-3, Medium Density Residential <br /> Applicable Regulations: <br /> 1104.01, Subd. 4: Accessory buildings detached from principal building shall have a side-yard <br /> setback of five feet. Accessory buildings shall not be allowed in the front yard. <br /> Attachments: <br /> 1. Planning Application <br /> 2. Zoning Map <br /> 3. Location Map <br /> 4. Site Plan <br /> Background: <br /> The applicant, owner of two contiguous properties on Hillview Road, each improved with four- <br /> unit multi-family structures, wishes to construct two three-stall garage structures between the two <br /> buildings to service both buildings. The garages would be setback from the common property line <br /> by one foot on each side. The applicant, since taking over ownership of these two properties, has <br /> invested considerable expense in rehabbing the buildings and making upgrades and improvements. <br /> The addition of a garage structure would without question be beneficial to the property, to its <br /> residents, and to the immediate area. <br /> This request in was before the Planning Commission at your last meeting on September 15, 1999, <br /> at which time it was thought that a variance could be avoided by combining the two parcels into <br /> one, effectively eliminating the interior lot-line. The problem with this solution was not with the <br /> County or applicant, but rather the applicant's two mortgagers. The applicant then asked to revise <br /> his request such that there would be two garage structures rather than one, each separated from the <br /> property line by one foot. <br />
