Johnson Variance Application <br /> 2075 &2081 Hillview Road <br /> October 6, 1999 <br /> Page 3 <br /> d. That granting the variance requested will not confer on the applicant any special <br /> privilege that is denied by this Title to owners of other lands, structures or buildings in <br /> the same district. <br /> The City Code requires that all (new) multi-family residential developments provide a <br /> minimum of one garage stall per dwelling unit. Currently, there are no garages on site and <br /> the applicant proposes to construct three for each building. Any new multi-family <br /> development would be required to provide the appropriate number of garage stalls. <br /> e. That the variance requested is the minimum variance which would alleviate the hardship. <br /> Economic conditions alone shall not be considered a hardship. <br /> There is 70 feet which separates the two four-plexes. Each of the proposed garage <br /> structures is 32 feet wide, which will barely accommodate three individual garage stalls. <br /> Were the garages to be any further apart than the requested one foot setback, the risk of <br /> damage to the four-plexes done by vehicles backing out of the garages would be too high. <br /> f. The variance would not be materially detrimental to the purpose of this Title or to other <br /> property in the same zone. <br /> Approving a variance to allow for the construction of the two three-stall garage structures <br /> would immediately improve the appearance of the subject properties and would be a <br /> welcomed addition to a street which has seen the introduction of blighting influences over <br /> the last few years. <br /> g. The proposed variance will not impair an adequate supply of light and air to adjacent <br /> property or substantially increase the congestion of the public streets or increase the <br /> danger of fire or endanger the public safety or substantially diminish or impair property <br /> values within the neighborhood. <br /> It is not expected that the addition of the proposed garages would have any detrimental <br /> effects upon the neighborhood. <br /> In reviewing these criteria, staff feels that the basis for establishing a hardship has been met, in <br /> that all of the criteria are satisfactorily addressed. Given this and the discussions of the Planning <br /> Commission and public testimony on September 15th, staff has drafted a resolution which <br /> approves of the variance as requested by the applicant. <br /> Recommendation: <br /> Approve Resolution 591-99, a resolution approving one-foot side yard setbacks for a three-stall <br /> garages to be located at 2075 and 2081 Hillview Road, according to the proposed building plans <br /> 0 <br /> on file. <br />
