Medtronic Review <br />October 10, 2005 <br />Page 12 <br /> <br /> (5) The demonstrated need for such use. <br /> <br />The need has been demonstrated by more than a year of discussions and <br />negotiations between the City and Medtronic, discussions and negotiations <br />between the City and the legislature, between the City and various state agencies <br />and has been expressed in a year of discussion and cooperation between the City <br />and the counties or Ramsey and Anoka, and the cities of Blaine and Shoreview, all <br />of who are supportive of this project. <br /> <br />Adverse Effects Summary: Staff and the Planning Commission, by virtue of their <br />resolution recommending approval of the rezoning, would submit that there are no <br />compelling adverse effects associated with this project, and any impacts resulting from <br />the proposed development will be or have been mitigated to the satisfactory approvals <br />of all governing agencies, including the Met Council, the Department of Natural <br />Resources, the Minnesota Department of Transportation, the Rice Creek Watershed <br />District, the Federal Highway Administration and the Federal Aviation Administration. <br /> <br />Planning Commission Action: <br /> <br />The Planning Commission reviewed and considered the development stage plans, the <br />preliminary plat and proposed rezoning at their meetings on September 21, 2005 and again <br />on October 5, 2005. Their resolution of approval is attached for the Council’s reference. <br /> <br />Recommendation: <br /> <br />Based upon all of the above information, the supporting plans and documentation associated <br />with this request, staff and the Planning Commission recommends the City Council open the <br />public hearing and take testimony from staff, the applicants, residents and other interested <br />parties and then consider the following actions: <br /> <br />1. Approve the Medtronic CRM development stage plans. Resolution 6630 is attached <br />for the Council’s consideration. <br /> <br />2. Approve the Medtronic CRM preliminary plat. Resolution 6631 is attached for the <br />Council’s consideration. Along with the resolution approving the preliminary plat, <br />Ordinance 765 which vacates the excess easements and right of way associated with <br />the Medtronic plat has been prepared and is available for introduction and first reading. <br /> <br />3.
