Resolution 6664 Authorizing Entering into Grant Agreement with Minnesota 13 <br />Department of Employment and Economic Development (DEED) in the 14 <br />Amount of $1,635,500 15 <br /> 16 <br />Councilmember Gunn stated that with the activity and dollar amount, she would like a staff 17 <br />report to inform the public what this relates to. 18 <br /> 19 <br />Mayor Marty read the Cooperative Agreement, Page 4, Item 13, last sentence, indicating: 20 <br />“Notwithstanding termination of this Agreement by the County due to the City’s inability to 21 <br />obtain funds from the State of Minnesota, the City shall remain liable to reimburse the County 22 <br />for all funds expended or owing to the consultant for work done prior to termination by the 23 <br />County of its contract with the consultant.” He asked what happens if the City does not get the 24 <br />money expected from the State. 25 <br /> 26 <br />Economic Development Coordinator Backman advised that Ramsey County does expect to be 27 <br />reimbursed for the services they incur. He explained that the City does have money earmarked, a 28 <br />$5 million appropriation that was put in the redevelopment account. The Council has a copy of 29 <br />the draft agreement his office received the last week of September. He stated he believes the 30 <br />City is protected that way. 31 <br /> 32 <br />Mayor Marty read Page 1 of the Design Grant, first line, indicating: “This agreement shall be 33 <br />effective as of April 12, 2005...” He stated this is the first he has seen this document. 34 <br /> 35 <br />Economic Development Coordinator Backman explained staff has had lengthy discussions with 36 <br />DEED on this agreement. The April date is included because there was work by Ramsey County 37 <br />pertaining to this but they knew there were no dollars until approved by the State, which occurred 38 <br />during the session. 39 <br /> 40 <br />Councilmember Thomas asked if it is retroactive. Economic Development Coordinator 41 <br />Backman answered in the affirmative. 42 <br /> 43 <br />Mayor Marty questioned the comment in Section 2.03, Completion of Predesign Stage, 44 <br />indicating: “The Public Entity shall diligently pursue and complete, or cause to be completed, 45
