<br /> <br />Item No: 7A <br />Meeting Date: Nov 28, 2005 <br />Type of Business: PH <br />Administrator Review : ______ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Public Hearing and Consideration of the Second <br />Reading and Adoption of Ordinance 766, an Ordinance <br />Authorizing the Vacation of a Drainage and Utility <br />Easement Associated with the Belting Office <br />Development at 5360 Edgewood Drive <br /> Introduction: <br /> <br />Dr. Greg Belting of Silverview Chiropractic Center (currently located at 2552 County Road <br />10) has entered into an agreement to purchase the empty lot behind Walgreens and has <br />received City Council authorization to construct an 8,300 square foot multi-tenant building for <br />himself and other small office type uses. The single story building would be situated against <br />the back of the lot so that the back of the building would front the wetland area rather than <br />the Community Center. <br /> <br />Background: <br /> <br />As the Council may recall during the development review presentation, it was pointed out <br />that when the lot was originally created with the Mounds View City Hall Addition plat, the <br />intended use of the lot was for a restaurant. Easements were platted assuming a certain <br />building configuration. Earlier this year the City Council authorized an amendment to the <br />Walgreens PUD to allow for an office use on the lot with a new site plan. To accommodate <br />this, the original easement will need to be vacated. In its place, a new easement would be <br />dedicated along the rear of the building, as shown in the attached exhibits. Rice Creek <br />Watershed District has conditionally approved the revised stormwater management plan <br />which involves the abandonment of the original easement and the creation of a new <br />stormwater infiltration area protected by a new easement. <br /> <br />Recommendation: <br /> <br />Given that the public hearing is still open, staff recommends seeking additional public input <br />before closing the hearing and approving the second reading and adoption of Ordinance <br />766, an ordinance authorizing the vacation of an easement associated with the Belting Office <br />Development on 5360 Edgewood Drive. The vote is a roll call vote and Staff would further <br />recommend the motion include authorization to publish an ordinance summary, consistent <br />with Charter Section 3.07. <br /> <br /> <br />James Ericson <br />Community Development Director <br />
