Wetland Zoning District Report <br />Dec 12, 2005 <br />Page 2 <br /> <br />Section 1010.06, Subd. 2: Modification of District: A wetland zoning district may be modified or <br />eliminated by four-fifths (4/5) affirmative vote of the Council after public hearing and notice as set <br />forth in Title 1100 of this Code. Wetland zoning districts may not be eliminated unless it can be <br />shown that the original designation is in error or that conditions have changed. When modifying <br />or removing a wetland zoning district, the Council shall use the criteria and methods established <br />in the Federal Manual for Identifying and Delineating Jurisdictional Wetlands dated January, <br />1989, as amended from time to time. <br /> <br />It should be noted that the manual referenced above is no longer the “Official” standard upon <br />which delineations are conducted, and a subsequent text amendment will need to be <br />processed. The intent remains the same however, that the delineation be conducted and <br />approved using an official adopted set of criteria, which has been done in this case. <br /> <br /> <br />Recommendation: <br /> <br />Staff has prepared Resolution 6683, a resolution approving a wetland zoning district map <br />amendment to the Spring Creek Wetland Basin as delineated by SEH in 2004 and approved <br />by Rice Creek Watershed District.
