<br />Item No: 9I <br />Meeting Date: Jan 26, 2004 <br />Type of Business: Council Business <br />Administrator Review : _______ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Jim Ericson, Community Development Director <br />Item Title/Subject: Consideration of Ordinance 730, an Interim <br />Ordinance Establishing a Moratorium on the Siting, <br />Location and Operation of New Adult Use Businesses <br /> <br />Background: <br /> <br />On October 13, 2003, the City Council adopted Ordinance No. 720 which eliminated the <br />designation of a Public Facilities Zoning District within the City of Mounds View. An <br />unintended consequence of this action was that certain properties and land uses were no <br />longer “protected” by a 500-foot buffer from Adult Uses. <br /> <br />Discussion <br /> <br />Staff consulted with the City Attorney who recommended that the City adopt an interim <br />ordinance establishing a moratorium on adult uses to provide an opportunity for staff to <br />conduct a study to determine whether additional or amended controls are necessary to <br />continue protecting the health, safety and well-being of the Community. <br /> <br />Interim ordinances do not require two readings and are effective upon their adoption by the <br />City Council. <br /> <br />Recommendation: <br /> <br />Staff recommends that the Council adopt Ordinance 730, an interim ordinance establishing a <br />three-month moratorium on the siting, location and operation of new adult use businesses. <br /> <br /> <br />Respectfully submitted, <br /> <br /> <br /> <br />________________________ <br />James Ericson <br />Community Development Director <br />763-717-4021 <br /> <br /> <br />Attachments: <br />1.
