<br />Item No: 9F <br />Meeting Date: 03/22/04 <br /> Type of Business: CB <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Kurt Ulrich, City Administrator <br />Item Title/Subject: Consideration of Charter Commission Recommendation to Amend <br />Section 4.02 Filing for Office <br /> <br />In a Charter Commission Resolution (No. 2004-01) dated February 12, 2004 (see <br />attached), the Charter Commission is requesting that the City Council respond within 60 <br />days with recommendations for modifications to any item that the City Council deems not <br />acceptable as presented. <br /> <br />I have reviewed the state statute referenced in the proposed amendment. One apparent <br />conflict with the language as written is the reference to paying a filing fee “in an amount set <br />by Ordinance . . . “ In fact, the section of the Statute referencing fees reads as follows: <br /> <br /> Subd. 3. Filing fees. Unless the charter of a city provides the amount of the fee for <br />filing an application or affidavit of candidacy for city office, the filing fee for a municipal <br />office is as follows: <br /> <br /> (a) In first class cities, $20; <br /> <br /> (b) In second and third class cities, $5; and <br /> <br /> (c) In fourth class cities and towns, $2. <br /> <br />The City’s charter does not provide the amount the amount of the fee for filing an <br />application or affidavit of candidacy for city office, nor does the City Code. The City’s <br />fee schedule, adopted by resolution, establishes a Filing Fee for Public Office at $20. <br /> <br />The Charter Commission’s recommended language, which references State Statute, <br />appears preferable to the current language. The language “in an amount set by <br />Ordinance . . . “ should be revised to read “in an amount set by Minnesota Statute . . . <br />“, or deleted. <br /> <br /> <br /> <br /> <br />
