The structure may not be located in or on a parking lot displacing parking stalls <br />unless it is shown an adequate amount of parking remained. <br /> <br />d. A Zoning Permit would be required annually, the duration of which cannot exceed <br />180 days. <br /> <br />e. The membrane or cover shall be constructed of a durable reinforced material to <br />withstand wind and snowloads. <br /> <br />f. The structure shall be anchored to the ground. <br /> <br />g. The tent or membrane structure shall be maintained in a good condition. <br />Deficiencies shall be corrected as soon as practicable. <br /> <br />h. The IUP can be reviewed at any time by the City if problems arise which would <br />necessitate revision or termination of the IUP. <br /> <br />i. The IUP would become null and void if the property owner fails to comply with the <br />provisions of the permit or if the structure is removed for more than a one-year <br />period, or if the property undergoes a change of ownership. <br /> <br />The Planning Commission also debated the appropriate duration of an IUP for a tent or <br />membrane structure. The outcome of this was that each tent or membrane structure could <br />warrant different durations depending upon different site-specific circumstances. The <br />Mermaid’s tent, for example, could be approved for an initial five-year period with five-year <br />extensions, while another commercial tent might justify a one -year approval with subsequent <br />two-year extensions. Differences may hinge on available parking, proximity to residential <br />districts and the nature of the proposed use. <br /> <br />The issue of “allowable size” was brought up at the City Council’s worksession on April 5, <br />2004. Staff has considered this and recommends that there should be a maximum area <br />allowed (5,000 square feet) as well as a maximum area not to exceed a certain percentage <br />(10%) of the building area. For sake of reference, the Mermaid’s tent is 4,200 square feet <br />and represents about 7% of the total building area. <br /> <br /> <br />Recommendation: <br /> <br />Review and consider the introduction and first reading of Ordinance 735.
