2. The estimated total of Spring Lake Park’s costs pursuant to this <br />Agreement, is $52,650 for the Hillview Road portion of the Improvements and <br />$56,500 for the Lakeside Lions Park portion of the Improvements, with Spring <br />Lake Park’s actual total cost for the Improvements being determined upon final <br />completion of the Improvements. <br /> <br /> 3. Upon award of a contract, Mounds View shall invoice Spring Lake <br />Park for its share of all costs incurred prior to said contract award. <br /> <br /> 4. Project cost administration shall be performed by Mounds View, <br />including payments to the contractor. Mounds View shall invoice Spring Lake <br />Park for its share of payments made to the contractor at the time each payment <br />is made to the contractor. <br /> <br /> 5. Spring Lake Park agrees to pay any invoices received from Mounds <br />View in accordance with this Agreement and within 30 days. <br /> <br />SECTION C <br />MAINTENANCE RESPONSIBILITIES <br /> <br /> 1. Maintenance and upkeep of the Improvements after completion <br />shall be in accordance with existing policies and responsibilities in place prior to <br />construction of the Improvements. <br />SECTION D <br />MISCELLANEOUS PROVISIONS <br /> <br /> 1. Compliance with Laws. The parties agree to comply with all laws, <br />ordinances and regulations of Minnesota applicable to this Agreement and the <br />construction of the Improvements. This Agreement shall be construed and <br />enforced according to the laws of Minnesota. <br />
