CVS Report <br />May 24, 2004 <br />Page 6 <br /> <br />Ordinance 739, which would amend the zoning of portions of Lots 1 and 2, is attached to the <br />report. If Council moves forward with the introduction and first reading of Ordinance 739 <br />tonight, the second reading and adoption would not occur until after the Council has given <br />final plat approval and the plat is recorded with Ramsey County. <br /> <br />This proposal was brought before the Planning Commission during the May 5 and May 19, <br />2004 meetings. The Planning Commission voted unanimously to recommend approval of the <br />preliminary plat, rezoning and development review. <br /> <br />Public Comment: Four residents spoke before the Planning Commission during the May 5, <br />2004 meeting. The residents had many questions about the development and raised a <br />concern about the safety of the ponds. One of the residents requested that a fence be <br />installed around the pond to deter children from playing near the pond, which the developer <br />agreed to do. Prior to the meetings, Staff received three comments from the public. Jerry <br />Jaker of the Minnesota Institute of Public Health voiced a concern that the new development <br />would generate more traffic at an already busy intersection. He stated that his employees <br />already have a difficult time with the intersection under current circumstances and adding a <br />retail store to the area would create additional traffic problems. Public Works Director Greg <br />Lee has indicated that the amount of traffic from the CVS site should not worsen the existing <br />situation, however the intersection could be scheduled for an assessment and could be <br />redesigned with new traffic lights to improve flow if the County feels it is necessary. Staff will <br />monitor the situation and take appropriate action if problems arise. The other comment <br />came from a citizen who was concerned that Mounds View already has two similar <br />businesses and does not feel that Mounds View will be able to support three such <br />businesses. The last comment came from a resident concerned that the proposed CVS <br />store is not compatible with the surrounding residential uses. The resident was also <br />concerned with the lighting and noise from a 24-hour business. <br /> <br /> <br />Recommendation: <br /> <br />Discuss the proposed preliminary plat and the associated issues surrounding the subdivision <br />and rezoning. The Council can take one of the following actions related to the request: <br /> <br />1. Approve the preliminary plat, rezoning and development review. Resolution 6270, a <br />resolution approving the preliminary plat and development review, is attached if the <br />Council chooses this option. Ordinance 739 is also attached if Council chooses to move <br />forward with the introduction and first reading. <br /> <br />2. Table the request. If additional information is needed before a decision can be rendered <br />or if more discussion is needed, the Council can simply move to table the request until <br />such information has been provided. If the Council chooses this option, Staff will need to <br />send a letter to the applicant informing them that the City will need additional time beyond <br />the 60-day requirement. <br /> <br />
