<br />TWELFTH RIDER <br />TO <br />AGREEMENT <br /> <br /> THIS AGREEMENT, Made this, 11th day of May, 2004 by and between the <br />BOARD OF WATER COMMISSIONERS OF THE CITY OF SAINT PAUL, <br />hereinafter called the Board, and the CITY OF MOUNDS VIEW, Ramsey County, <br />Minnesota, hereinafter called the City, being the Twelfth Rider to that certain Agreement <br />made by and between said Board and said City the 27th day of October1965, and by this <br />reference incorporated herein and made part and parcel hereof with the same intent, <br />purpose and effect as if said Agreement were set forth herein, verbatim. <br />WHEREAS, the Board now possesses title to a 60 foot wide easement in, over, <br />and across certain real estate in Section 6, Township 30 North, Range 23 West, Ramsey <br />County, said real estate being hereinafter called Premises; and <br />WHEREAS, the City desires permission to enter upon certain portions of said <br />Premises to complete street improvements; and <br />WHEREAS, the Board is willing to grant such permission to the City consistent <br />with the requirements and safety of the works of the Board. <br />NOW, THEREFORE, BE IT AGREED, in consideration of the mutual <br />promises and agreements of the parties hereto, that subject to all terms and conditions <br />contained in said Agreement between the parties hereto made and entered into the 27th <br />day of October 1965, the Board hereby grants to said City the permission: <br />1. Permitted Activity <br /> To complete 2004 street improvements in Knollwood Drive and <br />Groveland Road adjacent to County Road I. This work to include: <br />excavation, concrete curb and gutter, storm sewer, and street restoration. <br /> <br />
