Item No: 10B <br />Meeting Date: June 28, 2004 <br />Type of Business: Public Hearing <br />Administrator Review : ________ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Kristin Prososki, Planning Associate <br />Item Title/Subject: Public Hearing and Consideration of a Variance for a <br />Garage in Excess of Width Requirements and a <br />Conditional Use Permit for an Oversized Garage at <br />2208 Lois Drive; Planning Case No. VA2004-005 and <br />CU2004-001 <br /> <br /> <br />Introduction: <br /> Property owner Michael Read is requesting a variance and a conditional use permit to <br />expand his garage at 2208 Lois Drive. The variance and conditional use permit request <br />were heard before the Planning Commission on May 19, 2004. The Planning Commission <br />voted to deny the variance based on lack of hardship. Because the variance was not <br />granted, the Commission voted to recommend denial of the conditional use permit. Mr. <br />Read is exercising his right to appeal the Planning Commission’s denial of his variance <br />request. <br /> <br />The applicant indicates that the existing garage is too small to meet his storage needs and <br />that he would like to expand upon it by adding twenty-six feet on the west side of the existing <br />attached garage. The proposed width of the expanded garage is 48 feet, thirteen feet in <br />excess of what is allowed by City Code. <br /> <br />The subject lot has an area of 15,681 square feet and has 147 feet of frontage on Lois Drive. <br />Adjacent to the lot to the west is Judicial Ditch #1, which runs under Lois Drive through <br />Greenfield Park. A two-car garage is attached to the house to the west and there are two <br />smaller outbuildings in the back yard. <br /> <br />Discussion: <br /> <br />The request for a Conditional Use Permit to expand the 528 square foot garage by an <br />additional 624 square feet satisfies the requirements as stated in Section 1106.03 and <br />1106.04, Subdivision 6 of the Mounds View Zoning Code with the exception of the proposed <br />width of the building, which at 48 feet exceeds the maximum allowed width by thirteen feet. <br />The applicant has claimed a hardship and is requesting a variance to permit the 48-foot wide <br />garage. <br /> <br />The existing two-car garage is attached to the west side of the home and maintains the same <br />front setback as the house. The current setback is approximately 45 feet from the west lot <br />line and approximately 90 feet to the south lot line. The addition would be added on the west <br />side of the garage, which would create a 19-foot side setback on the west side. The <br />proposed square footage of the garage is 1,152 square feet.
