Scotch Variance and CUP Report <br />July 7, 2004 <br />Page 3 <br /> <br />Conditional Use Criteria <br /> <br />In granting a conditional use permit, the City Council shall consider the advice and <br />recommendations of the Planning Commission (see “Adverse Effects” on the next page), and <br />the effect of the proposed use on the Comprehensive Plan and upon the health, safety and <br />general welfare of occupants of surrounding lands. Among other things, the City Council shall <br />make the following findings where applicable: <br /> <br />(1) The use will not create an excessive burden on existing parks, schools, streets and other <br />public facilities and utilities which serve or are proposed to serve the area. <br /> <br />The proposed garage would cause none of these identified problems. <br /> <br />(2) The use will be sufficiently compatible or separated by distance or screening from adjacent <br />residentially zoned or used land so that existing homes will not be depreciated in value and <br />there will be no deterrence to development of vacant land. <br /> <br />The proposed garage should not cause depreciation in value of the existing homes and it <br />will not deter the development of vacant land. <br /> <br />(3) The structure and site shall have an appearance that will not have an adverse effect upon <br />adjacent residential properties. <br /> <br />The appearance of the proposed garage should not have an adverse effect on any of the <br />adjacent properties. <br /> <br />(4) The use, in the opinion of the City Council, is reasonably related to the overall needs of the <br />City and to the existing land use. <br /> <br />The property owners own multiple vehicles and recreational watercraft. The proposed <br />garage would be the only accessory structure on the property. The request is reasonably <br />related to their needs. <br /> <br />(5) The use is consistent with the purposes of the Zoning Code and the purposes of the zoning <br />district in which the applicant intends to locate the proposed use. <br /> <br />The Planning Commission and City Council encourage residents to make improvements to <br />their properties. One such common improvement is to expand garage space to <br />accommodate the needs of today’s multi-vehicle families. With the exception of the <br />maximum width requirement, this proposal is consistent with all zoning requirements and <br />the purpose of the R-1, Single Family zoning district. <br /> <br />(6) The use is not in conflict with the Comprehensive Plan of the City. <br /> <br />The proposed conditional use is consistent with the Comprehensive Plan. <br /> <br />(7) The use will not cause traffic hazards or congestion. <br /> <br />There will be no added traffic or congestion resulting from the proposed garage. <br />
