Item No: 10D <br />Meeting Date: July 26, 2004 <br />Type of Business: CB <br />Administrator Review : ____ City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Public Hearing, Second Reading and Adoption of <br />Ordinance 744, an Ordinance Vacating Unused and <br />Excess Public Easements Associated with the <br />Velmier CVS Redevelopment <br /> <br />Introduction: <br /> <br />On June 28, 2004, the City Council approved the final plat for the Velmier CVS Addition. <br />The plat combined the two lots created by the Amoco Silver Addition plat recorded in <br />1991 with parts of adjoining unplatted lots. As a result of the Velmier CVS Addition plat, <br />there are now easements in areas that are no longer needed or desired. The applicant <br />requests these easement areas be vacated. <br /> <br />Discussion: <br /> <br />Four easements are specifically requested to be vacated. The first easement area is the <br />easement dedicated to the City by way of the Amoco Silver Addition plat. This easement <br />is no longer needed as the lot line adjacent to this easement no longer exists and the <br />proposed CVS building sits on top of the easement. The second easement was <br />dedicated in 1970 as part of the subdivision which created the lot for the Silverview <br />Terrace apartment complex. The third and fourth easement areas were dedicated for <br />utility and right of way in the 1960s. While no roadway is planned or intended in the last <br />two easement areas, there are utilities which would continue to be protected by new <br />easements dedicated via the Velmier CVS Addition plat. <br /> <br />On July 12, 2004, the Council approved the first reading and introduction of the attached <br />ordinance. <br /> <br />Recommendation: <br /> <br />Hold the public hearing and consider the second reading and adoption of Ordinance 744, <br />an ordinance vacating excess and unused easements associated with the Velmier CVS <br />redevelopment project.
