<br />Item No: 10C <br />Meeting Date: August 23, 2004 <br />Type of Business: Public Hearing <br />Administrator Review : ____ <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Kristin Prososki, Planning Associate <br />Item Title/Subject: Second Reading and Adoption of an Ordinance to <br />Vacate Unused and Excess Public Utility and Highway <br />Easements Associated with the Hidden Hollow <br />Development <br />Introduction: <br />On June 28, 2004, the City Council approved the final plat for the Hidden Hollow major <br />subdivision. The plat created a new street dedicated as “Hidden Hollow Court” and 17 <br />residential lots. As a result of the Hidden Hollow plat, there are now easements in areas that <br />are no longer needed or desired. The applicant requests these easement areas be vacated. <br />The Council held the introduction and first reading of Ordinance 750 at the August 9, 2004 <br />City Council meeting. <br /> <br />Discussion: <br />Seven easements are requested to be vacated (see Exhibit A of Ordinance 750, attached). <br />Easements A, B, C and G were granted to the City in 1966 and 1967 for utility and highway <br />purposes. These easements are no longer needed, as the highway and utilities were not put <br />in place. Easements D and E were granted to the City for utility purposes, but are no longer <br />needed, as new drainage and utility easements in the same location were dedicated to the <br />City through the Hidden Hollow plat. The City took Easement F for utility purposes. The <br />utilities that were located in Easement F were either never put into place or are being <br />relocated for the new Hidden Hollow development. Only the portion of Easement F that is <br />located within the Hidden Hollow development will be vacated. Easement F also covers the <br />north 30’ of the properties to the south of the Hidden Hollow development. That portion of <br />the easement will be maintained. <br /> <br />New drainage and utility easements were dedicated with the Hidden Hollow plat, which <br />makes the easements described herein excess and unnecessary. (See attached plat). <br /> <br />Recommendation: <br />Approve the second reading and adoption of Ordinance 750, an ordinance vacating unused <br />and excess easements associated with the Hidden Hollow subdivision located south of <br />County Road H2, west of Knollwood Drive and east of the Western city limits. <br /> <br />Respectfully submitted, <br /> <br /> <br />Kristin Prososki <br />Planning Associate <br /> <br />Attachments: 1.
