Mike 20 <br />Kampa of the Mounds View Police Department. 21 <br /> 22 <br />The resolution was read aloud by Council Member Marty. 23 <br /> 24 <br />Ayes-5 – Nays –0 Motion carried. 25 <br /> 26 <br />J First Reading and Introduction of Ordinance 752, an Ordinance Amending 27 <br />the Zoning Code Relating to Driveway Setbacks. 28 <br /> 29 <br />Director Ericson stated that the City had asked Staff to look at the code requirements pertaining 30 <br />to driveway setbacks in residential districts, and that the issue stems from the current language 31 <br />which allows for a driveway to be set back up to one foot to the property line if the neighbor 32 <br />agrees to that. He stated that normally the setback for driveways in an R-1/R-2 district would be 33 <br />five feet. He stated the Council had had concerns that the neighbors would have too much 34 <br />power in granting this right to have the driveway there. He stated that there had been problems 35 <br />where the driveway was located too close to the property line, and that the driveway even went 36 <br />over the property line. 37 <br /> 38 <br />Director Ericson stated the issue had been to the Planning Commission, and that the Planning 39 <br />Commission had recommended that the language be struck from the City Code, and if somebody 40 <br />has a hardship that would warrant having a setback of less than five feet, then they would need to 41 <br />go through the administrative variance process. 42 <br /> 43
