Crane, Administrative Assistant <br />Item Title/Subject: Second Reading of Ordinance 748, Amending Section 4.05 of the <br />City Charter Regarding Vacancy of Municipal Elected Office <br /> <br /> <br />On August 23, 2004, the City Council approved the first reading and introduction of <br />Ordinance 748, an Ordinance amending Section 4.05 of the Mounds View City Charter <br />relating to “Vacancy of Municipal Elected Office.” On September 13, 2004, a Public <br />Hearing was held but the vote was postponed because not all members of the Council <br />were present. A unanimous vote is required in order for this Ordinance to pass. <br /> <br />Discussion: <br /> <br />The intent of the Charter Commission with this resolution is to clarify language in the <br />charter relating to the Vacancy of Municipal Elected Office. <br /> <br />Staff and the Mounds View City Attorney have reviewed this amendment and support the <br />adoption of Ordinance 748. Consistent with state law, the ordinance would go into effect <br />90 days after unanimously being adopted by the City Council. <br /> <br />Recommendation: <br /> <br />Consider the second reading and adoption of Ordinance 748, an ordinance amending <br />Section 4.05 of the City Charter regarding Vacancy of Municipal Elected Office.
