S 517.03: General Requirements and Required Information Subd. 1. No person or entity shall operate a business in the City without first obtaining a Business registration Certificate(BRC)issued by the City. Subd. 2. The owner or manager of a business operating in or locating in Mounds View shall submit a completed application for a Business Registration Certificate (BRC)with the City on a form furnished by the City. The application shall be filed with the Community Development Department at least 30 days prior to any business's intended occupancy, or 30 days prior to the existing`BRC's" expiration date. Subd. 3. All BRCs shall be effective from January 1 to December 31 of each year. Any business operating within the City before the enactment of this section is required to make application to the City for a BRC within 60 days of the effective date of this section. Subd. 4. The City will not automatically renew a BRC. Owners,managers or other responsible persons must submit an application for renewal of a BRC to the City at least 30 days before the BRC's expiration date. Subd. 5. A non-refundable application fee, in the amount established by the City Council,shall be paid to the City and accompany a BRC application. • Subd. 6. When the holder or user of a BRC legally changes its business name and such change does not substantially change the business operations or activities, the business owner or responsible person shall reapply to the City for a new BRC. In such a case,the City will not require or charge an additional application fee for the new BRC. 517.04: Issuance of Business Registration Certificate(BRC) Upon receipt of a completed BRC application form, City review of the BRC application and verification by City Staff that the business meets the requirements of City Code, State Fire and Building Codes,the City will issue a BRC to the applicant or owner. 517.05:Violations Any person or business that violates any of the provisions of this Chapter shall be guilty of a misdemeanor. SECTION 2. This ordinance takes effect 30 days after its publication in the official City newspaper. INTRODUCTION AND FIRST READING by the Mounds View City Council this 13th day of July, 2009.
