WHEREAS, on July 22, 2003, the City and Pro Craft Homes signed a pre- <br />development agreement regarding “The Woods of Mounds View” proposed <br />project; and <br /> <br /> WHEREAS, on February 4, 2004 Pro Craft Homes and the Fyksens <br />signed a purchase agreement to sell the Fyksen property to Pro Craft Homes for <br />this residential subdivision project; and <br /> <br /> WHEREAS, the acquisition by the City and EDA of Lot 36, Knollwood <br />Park, Ramsey County, Minnesota, is necessary for the full development and <br />redevelopment of the area surrounding Lot 36, Knollwood Park, Ramsey County, <br />Minnesota; and <br /> <br /> WHEREAS, to address the issue of public purpose pertaining to land <br />governed by a use deed and to adequately control and promote the orderly <br />development of the area, City staff recommends the acquisition of the remaining <br />tax forfeited land on County Road H2 identified as Lot 36, Knollwood Park, <br />Ramsey County, Minnesota; and <br /> <br />WHEREAS, the use to be made of Lot 36, Knollwood Park, Ramsey <br />County, Minnesota, is as a portion of a subdivision development and <br />accompanying potential public utility, drainage and storm water pond purposes, <br />and the public purpose for acquiring Lot 36, Knollwood Park, Ramsey County, <br />Minnesota, is for the development and redevelopment of the area surrounding <br />Lot 36, Knollwood Park, Ramsey County, Minnesota; and <br /> <br />WHEREAS, consistent with the authority to acquire, develop and <br />redevelop real property within the City provided to the City and the EDA by <br />Mounds View City Charter Sections 1.02 (Powers of the City),1.03 (Charter a <br />Public Act), 9.01 (Acquisition of Property) and 12.05 (Sale of Real Property), <br />Minnesota Statutes Chapter 410 (Charters) and Minnesota Statutes Sections <br />469.090 through 469.123 (Economic Development Authorities) (in particular, <br />Minnesota Statutes Section 469.101, subdivisions 2, 5, 9, 10 17, and 18), the <br />City and EDA have determined that it is in the public interest and find that a <br />public purpose exists as stated herein and above for the promotion and <br />facilitation of the development and redevelopment of the area surrounding Lot <br />36, Knollwood Park, Ramsey County, Minnesota, through the private <br />development and redevelopment of a residential subdivision and a return of Lot <br />36, Knollwood Park, Ramsey County, Minnesota, to the tax rolls of all taxing <br />jurisdictions affecting Lot 36, Knollwood Park, Ramsey County, Minnesota. <br /> <br /> NOW, THEREFORE BE IT RESOLVED THAT, the Mounds View City <br />Council and the Mounds View Economic Development Authority hereby adopt <br />the recitals set forth above in this resolution as the findings of the City and EDA <br />regarding the matters referenced herein, and that such recitals are incorporated <br />into and made part of this resolution.
