CVS Rezoning Report November 22, 2004 Page 2 The table below shows the current and proposed zoning of each of the three lots. Current Zoning Proposed Zoning Lot 1 B-3 and R-3 B-3 Lot 2 B-3, R-3 and R-4 B-3 Lot 3 R-4 and R-3 R-4 Ordinance 739, which would amend the zoning of portions of Lots 1, 2 and 3, is attached to the report. This proposal was brought before the Planning Commission during the May 5 and May 19, 2004 meetings. The Planning Commission voted unanimously to recommend approval of the rezoning. The Council held the introduction and first reading of this ordinance on May 24, 2004 and at that time it was stated that the second reading and adoption would not occur until after the Council had approved the final plat (which occurred on August 28, 2004) and after the plat had been recorded with Ramsey County. The plat is currently in the recording process and the rezoning is contingent upon the recording being complete. Although a public hearing was held during the introduction and first reading of Ordinance 739, due to the amount of time between the two readings, Staff again notified the property owners within 350 feet of the subject properties. Staff only received one call from a neighboring resident asking for clarification of the request. The property owner was not against the rezoning. Recommendation: Hold the public hearing and consider the second reading and adoption of Ordinance 739, an ordinance rezoning portions of Lots 1, 2 and 3, Block 1 of the Velmeir CVS Addition associated with the CVS redevelopment project.
