CVS Rezoning Report <br />November 22, 2004 <br />Page 8 <br /> <br /> <br />WHEREAS, in accordance with Section 1204.04, Subd. 4, the subdivision is subject to a <br />park dedication fee which would be equivalent to 10% of the assessed value of the project area, <br />which has yet to be determined; and, <br /> <br />WHEREAS, the proposed subdivision is NOT within a Wetland Zoning District; and, <br /> <br />WHEREAS, the grading and drainage plan are being reviewed by the City Engineer and is <br />subject to Rice Creek watershed District approval; and, <br /> <br />WHEREAS, the Planning Commission held a duly noticed public hearing regarding this <br />preliminary plat on Wednesday, May 5, 2004; and, <br /> <br />WHEREAS, before development may proceed, the Planning Commission and City <br />Council are required to review and approve all applications for development; and, <br /> <br />WHEREAS, proof of parking (up to 15% of the total parking requirement) can be <br />granted by the City Council when it is determined that the parking requirement is greater than <br />needed; and, <br /> <br />WHEREAS, the City Code indicates that rezoning requests shall be consistent with the <br />Future Land Use Map of the Comprehensive Plan and that the Planning Commission shall find <br />that the rezoning would not be detrimental to the neighborhood or adversely affect any adjoining <br />properties. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View Planning Commission <br />hereby makes the following findings of fact related to the rezoning request: <br /> <br />1. The Future Land Use Map of the Comprehensive Plan designates this area as a Mixed <br />Use Planned Unit Development. The proposed Highway Business zoning district would <br />not be inconsistent with the vision for this area. <br /> <br />2. The rezoning of the property would not adversely affect any adjacent or nearby properties. <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View Planning <br />Commission, based upon its review of the documentation and findings of fact, recommends <br />approval of the rezoning request of portion of Lots 1 and 2 from R-3 and R-4 to B-3. <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View Planning <br />Commission, finding that the submitted preliminary plan satisfies City Code, recommends <br />approval of the “Velmeir CVS Addition” preliminary plat subject to the following conditions: <br /> <br />1. The applicant shall arrange to have a Registered Property Abstract (RPA) or other <br />acceptable title commitment provided to the City Attorney for review prior to the <br />approval of the subdivision by the City Council.
