<br />(Rev. 11/96) <br /> <br />CHAPTER 1123 <br /> <br />NONCONFORMING BUILDINGS, STRUCTURES AND USES <br /> <br /> <br /> <br />SECTION: <br /> <br />1123.01: Purpose <br />1123.02: Continuance of Nonconforming Uses <br />1123.03: Discontinuance of Nonconforming Use <br />1123.04: Change of Nonconforming Use <br />1123.05: Repairs and Maintenance <br />1123.06: Alterations <br />1123.07: Damage and Destruction <br />1123.08: Moving Buildings <br /> <br /> <br /> <br />1123.01: PURPOSE: It is the purpose of this Chapter to provide for the regulation of <br />nonconforming buildings, structures and uses and to specify those requirements, circumstances and <br />conditions under which nonconforming buildings, structures and uses will be operated and maintained. <br />The Zoning Code establishes separate districts, each of which is an appropriate area for the location of <br />uses which are permitted in that district. It is necessary and consistent with the establishment of these <br />districts that nonconforming buildings, structures and uses not be permitted to continue without <br />restriction. Furthermore, it is the intent of this Chapter that all nonconforming uses shall be eventually <br />brought into conformity. (1988 Code §40.03) <br /> <br /> <br />1123.02: CONTINUANCE OF NONCONFORMING USES: <br /> <br />Subd. 1. Continuance of Use: <br /> <br /> a. General: Any structure or use lawfully existing prior to a revision to this Code or a change in <br />a zoning district designation which makes the structure or use nonconforming shall not be <br />enlarged but may be continued at the size and in the manner of operation existing upon such <br />date, except as hereinafter specified or subsequently amended.
