<br />Resolution 6396 <br />Page 2 <br /> <br /> <br />WHEREAS, the Mounds View City Council makes the following findings of fact <br />related to this request: <br /> <br />1. The Station, located at 2280 County Road I, property zoned B-2, Limited <br />Business, is a considered legal, non-conforming use. <br />2. Motor fuel stations are not permitted in the B-2, Limited Business District <br />3. According to the Comprehensive Plan, Motor fuel stations are not appropriate <br />uses in areas designated “Neighborhood Commercial “ <br />4. The Station does not comply with the minimum lot area for a motor fuel <br />station—22,500 square feet. The Station’s area is only 9,583 square feet. <br />5. The Station does not comply with the minimum lot dimensions for a motor <br />fuel station—150’ x 130’. The Station’s dimensions are 134’ x 71’. <br /> <br />WHEREAS, the Mounds View Planning Commission, by its adoption of Resolution <br />775-04, has recommended denial of the conditional use permit request. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the Mounds View City Council, based <br />upon the above findings of fact and Planning Commission recommendation, does hereby <br />deny the conditional use permit request for The Station, located at 2280 County Road I. <br /> <br />NOW, THEREFORE, BE IT FURTHER RESOLVED, the Mounds View City Council <br />recognizes the right of “The Station” to continue operating at its present location at 2280 <br />County Road I as a legal non-conforming use. <br /> <br />Adopted this 22nd day of November, 2004. <br /> <br /> <br />_____________________________________ <br />Jerry Linke, Mayor <br /> <br /> <br />ATTEST: <br />____________________________________ <br />Kurt Ulrich, City Clerk / Administrator <br /> <br /> <br />(SEAL) <br /> <br /> <br />
