Mounds View City Council November 22, 2004 <br />Regular Meeting Page 6 <br /> <br /> 1 <br />Acting Mayor Marty closed the public hearing. 2 <br /> 3 <br />Acting Mayor Marty stated that the City Attorney had indicated that adding a fuel pump island 4 <br />would constitute an expansion of a nonconforming use, which is prohibited, and the station does 5 <br />not satisfy the minimum conditional use permit requirements for a fuel station as far as lot size, 6 <br />parking setbacks, lot width, and zoning. He stated this would not fit within the Comprehensive 7 <br />Plan. 8 <br /> 9 <br />Councilmember Stigney stated he had attended the Planning Commissioner meetings on this 10 <br />item, and that they had conducted a very thorough examination of all the criteria involved in this, 11 <br />and he stated that he supported the Planning Commission’s recommendation to deny the 12 <br />conditional use permit. 13 <br /> 14 <br />MOTION/SECOND. Stigney/Gunn. To approve Resolution 396, denying approval of the 15 <br />conditional use permit for The Station. 16 <br /> 17 <br /> Ayes-4 Nays-0 Motion carried. 18 <br /> 19 <br />C. Second Reading and Adoption of Ordinance 753, an Ordinance Establishing 20 <br />a New Chapter 609 of the Mounds View Municipal Code Entitled “Cleanup 21 <br />of Clandestine Drug Labs Sites -- Roll Call Vote 22 <br /> 23 <br />Director Ericson stated that this ordinance had been discussed at the meeting on November 8th, 24 <br />and it would give the city additional tools to seek reimbursement for costs associated with the 25 <br />cleanup of an illegal drug lab if one were found in the community. 26 <br /> 27 <br />MOTION/SECOND. Quick/Stigney.
