Item No: 8E <br />Meeting Date: Jan 27, 2003 <br />Type of Business: CB <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Interim City Administrator <br />Item Title/Subject: Consideration of Ordinance 709, an Emergency Interim <br />Ordinance Regulating the Presence and Siting of Pawn Shops <br />and Related Establishments within the City of Mounds View <br /> <br />Introduction: <br /> <br />Staff has been approached by a group interested in establishing a pawn shop in the City. <br />There are currently no provisions in the City Code regarding the siting or regulation of <br />such a business. <br /> <br />Discussion: <br /> <br />The City has considered the issue and the lack of language relating to the regulation of pawn <br />shops and continues to consider the issue of whether the City should adopt an ordinance to <br />address the City health, safety and welfare issues caused by pawn shops and related <br />establishments within the City. City staff has made an initial review of this matter and <br />recommends that this matter be more fully studied. <br /> <br />The City Council has authority, pursuant to Section 3.06 of the City of Mounds View City <br />Charter and Minnesota Statutes Section 462.355, Subdivision 4, to adopt an emergency <br />interim ordinance during which time the City will conduct a study of the possibility of adopting <br />new or amended controls to fulfill the City's legal obligation to adequately protect the public <br />health, safety and welfare. <br /> <br />Recommendation: <br /> <br />Because no land use controls or regulations exist for pawn shops and related establishments <br />within the City, staff recommends Council adopt the attached emergency interim Ordinance <br />709 which directs the City of Mounds View Planning Commission to conduct a study of this <br />matter and make recommendations as to the adoption of amended official controls or <br />regulations to fulfill the City's legal obligation to adequately protect the public health, safety <br />and welfare.
