To Waive the Reading and Approve Resolution 5942, a 1 <br />Resolution Awarding the Construction Contract for the Water Tower Rehabilitation Project. 2 <br /> 3 <br />Council Member Marty asked why the engineers estimate was so far off from the actual bid. 4 <br /> 5 <br />Public Works Director Lee indicated that this type of project is difficult to estimate and then explained 6 <br />that the interior wet painting and exterior painting were items that were underestimated. 7 <br /> 8 <br /> Ayes – 5 Nays – 0 Motio n carried. 9 <br /> 10 <br />C. Resolution 5943, a Resolution Amending Personnel Manual to Establish a Sick 11 <br />Leave Donation Policy. 12 <br /> 13 <br />Chief Sommer indicated the reason for this resolution was that a Mounds View police officer was 14 <br />injured off duty and required a lengthy recovery time. This officer was a newly hired officer and had not 15 <br />accrued much sick leave and has now exhausted that time. Chief Sommer indicated the labor contract 16 <br />for patrol officers allows Mounds View officers to borrow up to 30 days of sick leave and this 17 <br />resolution would address that and allow all City employees in catastrophic health injuries or death of a 18 <br />family member to use sick leave that is donated by fellow employees in an amount up to 30 days. 19 <br /> 20 <br />Chief Sommer handed out revised copies of Resolution 5943. 21 <br /> 22 <br />David Jahnke indicated he was a union steward on the management side and looking at this he 23 <br />suggested the City proceed very carefully. He then commented there was an arbitration case where 24 <br />employees were donating time and were not at the company. 25 <br /> 26 <br />Council Member Marty indicated the Resolution indicates that the borrowed time goes back to the 27 <br />donor if the recipient leaves the employment of the City. 28 <br /> 29 <br />Council Member Stigney asked what would happen to the donated time. 30 <br /> 31 <br />Interim City Administrator Ericson indicated the amounts would be pro rated based on what was 32 <br />donated and what was used and returned to the employee that donated the time. 33 <br /> 34 <br />Council Member Marty asked if the FMLA laws allow the use of sick time for family members. 35 <br /> 36 <br />Mayor Linke indicated that an employee can use sick time for immediate family members through the 37 <br />FMLA. 38 <br /> 39 <br />Council Member Quick asked how this would affect the union contract as it is not a provision in the 40 <br />contract. 41 <br /> 42
