Variance Appeal <br />March 24, 2003 <br />Page 14 <br /> <br /> <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, based upon the testimony submitted <br />by staff, the Planning Commission, the applicants and the general public, the Mounds <br />View City Council makes the following finding of facts related to this request: <br /> <br />1. There are no exceptional or extraordinary conditions relating to this request or <br />to the property. <br /> <br />2. The literal interpretation of the Zoning Code, Chapter 1121, Parking <br />Requirements, does not deny the applicant rights commonly enjoyed by other <br />R-3 properties. <br />3. The applicants, by virtue of their desire to expand the building, have caused <br />the conditions which necessitate the variance request. <br />4. Granting the variance would confer upon the applicant a special privilege not <br />enjoyed by others in this zoning district. <br />5. Granting the variance would be detrimental to the neighborhood in that <br />parking problems already present would be exacerbated. <br /> <br /> NOW, THEREFORE, BE IT FURTHER RESOLVED that the Mounds View City <br />Council, based upon the above identified finding of facts, does hereby uphold the <br />Planning Commission’s denial of the variance requested for a reduction in the parking <br />requirements associated with the expansion of the four plex located at 2075 Hillview <br />Road. <br /> <br />Adopted this 24th day of March 2003. <br /> <br /> <br />_____________________________________ <br />Jerry Linke, Mayor <br /> <br /> <br />ATTEST: <br /> <br />_____________________________________ <br />James Ericson, Interim City Administrator <br /> <br /> <br />(SEAL) <br /> <br /> <br /> <br />
