<br /> <br />arrive at an “adjusted“ dedication fee. The Martinson property originally exceeded one acre, <br />and as such, they were assessed a ten percent fee equal to $2,110. According to the Code, <br />that payment should be subtracted from what would be owed from the new subdivision. <br />Because the new subdivision is less than an acre, a five percent fee would be imposed. The <br />end result is that no additional dedication is required above and beyond what has already <br />been paid. <br /> <br />Recording Requirements. The Subdivision Code indicates that If the certificate of survey is <br />approved by the Council, the “subdivider“ shall, within sixty (60) days, record with Ramsey <br />County a deed conforming to the terms of the Council’s approval of the subdivision, and within <br />ten (10) days of the recording, the subdivider shall furnish the City with a copy of the deed <br />showing evidence of the recording; otherwise, the subdivision shall be void and the <br />Clerk-Administrator would so notify the County Register of Deeds or Registrar of Titles. No <br />building permit can be issued for construction on a parcel created by such minor subdivision <br />until evidence of recording has been submitted. In this case, however, because the lot is <br />already properly zoned for a twin-home, construction can occur at any time. <br /> <br />Deed Restrictions. According to Section 1107.03 of the Mounds View Zoning Code, deeds <br />associated with zero lot line parcels shall have certain restrictions added to the deed that <br />protect what happens in the event of damage or destruction. The restrictions are as follows: <br /> <br />a. If one dwelling unit is burned or destroyed, it shall be reconstructed in a uniform <br />appearance. <br />b. If both dwelling units are burned or destroyed, minimum lot widths shall then prevail <br />as for single-family homes. <br />c. A double dwelling unit may be rebuilt meeting the original conditions of this Title. <br />d. A uniform exterior appearance, in terms of color, design and maintenance shall be <br />maintained. <br /> <br />Planning Commission Action: The Planning Commission unanimously recommended <br />approval of this subdivision at their meeting on February 19, 2003. Their resolution is <br />attached for your reference. <br /> <br />Recommendation: <br /> <br />Staff and the Planning Commission recommends approval of the attached Resolution 6003, <br />a Resolution recommending approval of a minor subdivision (zero-lot line) of 7656 Silver <br />Lake Road as requested by RM Michaels Construction Inc., with stipulations noted as <br />follows: <br /> <br />1. The dwelling units shall have separate utility services. <br />2. Deeds shall have restrictions as addressed herein and in Subd. 1107.03 of the Zoning <br />Code. <br />3. Deeds shall be recorded with Ramsey County within 60 days of Council approval. (This <br />requirement may be waived by the City Administrator for good or just cause.) <br />4. Each resulting dwelling unit shall meet existing building codes <br />5. The builder shall obtain access permits from Ramsey County prior to commencing <br />work. <br />
