Mounds View City Council June 23, 2003 <br />Regular Meeting Page 19 <br /> <br />Interim City Administrator Ericson indicated that Mr. Kelly is a very well respected attorney and, 1 <br />after checking with a city that he represents, there has never been an occasion where they had an 2 <br />issue that could not be handled by the firm so he would not want to exclude them on firm depth. 3 <br /> 4 <br />Council Member Quick indicated he did not agree with interviewing anyone as he feels the City 5 <br />should stay with Kennedy and Graven. He also commented that there is not enough difference in 6 <br />the fees to justify all the expense of the process. 7 <br /> 8 <br />Council Member Marty indicated he wanted to interview Kelly and Faucet and Barna Guzzy. 9 <br /> 10 <br />Council Member Stigney indicated he wanted to stay with Kennedy and Graven. 11 <br /> 12 <br />Council Member Gunn indicated she would feel comfortable staying with Kennedy and Graven. 13 <br /> 14 <br />Mayor Linke indicated that the City would stay with Kennedy and Graven and would not be 15 <br />interviewing any other firms. He then suggested the City discuss ways to reduce attorney fees 16 <br />such as not having an attorney at the Council meetings. 17 <br /> 18 <br />City Attorney Riggs indicated he feels there are things that could be done differently and 19 <br />suggested coming to a work session to discuss them. 20 <br /> 21 <br />Council Member Marty indicated he has concerns with Kennedy and Graven because he has 22 <br />asked several times to see the legal outcome from the golf course from inception to the lawsuit 23 <br />that was lost and he also has concerns with the Kessel and Hammerschmidt matters and the legal 24 <br />advice given by the attorney. 25 <br /> 26 <br />Council Member Quick indicated that Kennedy and Graven was not the attorney on that case. 27 <br /> 28 <br />Council Member Stigney asked if the City Attorney had any issue dealing with an unsigned 29 <br />contract. 30 <br /> 31 <br />City Attorney Riggs indicated the City could fire an attorney at any given time. 32 <br /> 33 <br />Council Member Stigney asked if the City Attorney could sue the City for firing him. 34 <br /> 35 <br />City Attorney Riggs indicated that ethically he could not put language into a contract to that 36 <br />effect because the Council has the right to seek legal counsel from anybody at any given time 37 <br /> 38 <br />10.
