Item No: 8A <br />Meeting Date: September 22, 2003 <br />Type of Business: Consent <br />City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: James Ericson, Community Development Director <br />Item Title/Subject: Property Owner Requests City’s Consent to Locate a <br />Parking Area One-Foot from City Owed Right of Way <br /> <br />Introduction: <br /> <br />The property owner at 2508 Hillview Road is requesting permission to locate a parking area <br />within one foot of his property line. This is NOT a variance request—the Code allows such a <br />setback provided consent from the adjacent property owner is given. <br /> <br />Discussion: <br /> <br />The City Code allows for a one-foot set back to the lot line with approval of the adjacent <br />property owner. In this case, the adjacent property owner is the City of Mounds View. The <br />city land is unimproved future right of way for what could in the future become Skiba Drive. <br />While the City currently owns three interior lots that would take access from this right of way, <br />there have been no plans to move ahead with development in this area. <br /> <br />The subject property owners and the property owners on the other side of the right of way <br />have ensured that the grass is cut and that the area appears well kept. The Dreshars have a <br />privacy fence that extends out from their garage to the side lot line and alongside the side lot <br />line going to the back of their lot. The proposed parking pad would replace with asphalt an <br />existing dirt and gravel area where the Dreshars currently park their boat and motor home. <br />The parking area is screened from public view by the fence. <br /> <br />A location map and the property owner’s request are attached for your reference. <br /> <br />Recommendation: <br /> <br />Staff has identified the various options regarding this request, which are as follows: <br /> <br />1. Approve Resolution 6100 granting consent to the one-foot setback as requested. <br />2. Approve Resolution 6100 granting consent, with conditions the Council deems <br />appropriate. <br />3. Table action on the resolution pending receipt of additional information. <br />4.
