It was suggested that the prohibited acts identified in Section 516.14 <br />should be referenced in Section 516.13, the section dealing with suspension and <br />revocation. The prohibited acts ARE referenced, however in a broad sense with the <br />following language: “The City Council may suspend or revoke a license issued under <br />this chapter upon a finding of violation of . . . any of the provisions of this chapter” <br />which of course includes Section 516.14. While the prohibited acts COULD be <br />referenced if desired for additional emphasis, it would be redundant. <br /> <br /> <br />Summary: <br /> <br />In closing, and as the Council is aware, the City cannot simply decide to prohibit a use from <br />locating within the City. The City can, however, regulate the time, manner and location of <br />uses and impose licensing fees and requirements to ensure the health, safety and welfare of <br />the community. When the City Council adopted Ordinance 709 in February of this year, the <br />direction was given for the Planning Commission to research, review and draft ordinances to <br />control and regulate such a business. The Commission has completed this process and <br />their resolution adopted on May 7, 2003 recommends to the City Council Ordinances 711, an <br />ordinance amending the Zoning Code, and Ordinance 712, an Ordinance amending the <br />Business License Regulations of the City. The Planning Commission is NOT recommending <br />that the City attract a Pawnshop but rather is recommending adoption of the two ordinances <br />to PROTECT the City in the event one does attempt to locate here. <br /> <br /> <br />Recommendation: <br /> <br />The Planning Commission and Staff recommend the City Council review the two draft <br />ordinances and if found acceptable, to move their introduction and first reading. If the City <br />Council desires additional information or would like more time to review the proposed <br />amendments, a tabling action would be in order.
